Welcome to the EarthRescue website. These Terms of Use ("Terms") form a legally binding agreement between you, whether as an individual or on behalf of an entity ("user" or "you"), and EarthRescue, EarthChildren Rescue, and EarthWildlife Rescue (referred to as “EarthRescue”, "we", or "us") regarding your access to and use of the website and social media accounts at www.earthrescue.us and earth-children.org, along with all associated subdomains, online services, and mobile applications (collectively referred to as the "Site"). These Terms do not modify any other agreement you may have with EarthRescue. If you are accessing the Site on behalf of an entity, you affirm that you are authorized to accept these Terms for that entity, which agrees to indemnify you and EarthRescue for any violations.

Acceptance of Terms of Use

Please review these Terms of Use carefully before utilizing the Site. By accessing the Site, you consent and agree with these Terms. If you do not agree, please refrain from using the Site.
If you are under 13 years old, you should not use the Site. If you are under 18, you may only access the Site with legal parental or guardian consent to accept these Terms and the ability to comply with them. If you purchase any products or services or engage in contests or promotions via the Site, you confirm that you are over 18, have the authority to accept these Terms, and can fully comply with them. If you are under 18, do not make any purchases or participate in these activities on the Site. EarthRescue does not knowingly collect information from children under 13; if you are under 13, please do not submit any personal information.

Changes to Terms of Use

EarthRescue reserves the right to alter or modify these Terms or any policy or guideline on the Site at any time. Changes will take effect immediately upon posting on the Site. Your continued use of the Site after changes signifies your acceptance of the modifications. Therefore, it is advisable to review the Terms and related policies periodically. If you disagree with the revised terms, you must stop using the Site.

General

EarthRescue operates the Site from the United States. T We do not represent that materials on the Site are suitable or available for use in other locations, and accessing the Site from geographic locations where its contents are illegal is prohibited. Those who choose to access the Site from other locations do so voluntarily and are responsible for adhering to local laws.

Copyright and Limited License

EarthRescue maintains the Site for educational, charitable, and informational purposes, strictly for personal, non-commercial use. Unless stated otherwise, the Site and all associated content and materials (collectively referred to as "Site Materials") are the proprietary property of EarthRescue or its affiliates and licensors, protected by U.S. and international copyright, trademark, and intellectual property laws. You are granted permission to access and use the Site and to display, copy, print, and download Site Materials for personal use, provided you do not modify them and retain all proprietary notices. This permission does not extend to:  
(a) Commercial use or resale of the Site or its Materials;
(b) Distribution or public display of Site Materials;
(c) Creating derivative works from the Site and its Materials;
(d) Employing data mining or similar extraction methods; or
(e) Any use of the Site or Materials outside their intended purpose.   Permission can be revoked at any time, for any reason. Except as explicitly stated, no Site Materials may be copied, reproduced, distributed, or used in any form without the prior written consent of EarthRescue or the copyright owner. Permission terminates automatically if you breach any of these Terms, and you must immediately destroy any downloaded or printed materials. You may not "mirror" any Site materials on another server without permission. Unauthorized use may violate applicable laws.

Copyright Complaints 

If you believe your copyrighted work has been used without permission in a way that constitutes infringement, please provide EarthRescue with the following information:  
1. A description of the copyrighted work claimed to be infringed;  
2. A description of where the infringing material is located on the Site;  
3. Your contact information;  
4. A statement confirming your good faith belief that the disputed use is unauthorized; 
5. A statement that the information provided is accurate and that you are the copyright owner or authorized to act on their behalf; and  
6. An electronic or physical signature of the authorized person.

Trademarks 

The name ‘EarthChildren’ is a trademark of EarthRescue and may not be used without prior written permission. The overall look and feel of the Site, including page headers and graphics, is also protected and may not be copied without consent. References to products or services by trade name or trademark do not imply endorsement by us. 

Feedback and Materials 

We welcome your feedback regarding EarthRescue's products, services, or the Site. Any feedback sent to us will be considered non-confidential and will become the property of EarthRescue. You assign all rights in the feedback to EarthRescue, which may use it freely. You waive any moral rights in the feedback.  

Links to Other Websites

The Site may include links to third-party websites ("Third Party Sites") and other content not controlled by EarthRescue. We do not endorse or assume responsibility for any Third Party Sites or content, and your use of them is at your own risk.

Sites Linking to This Site

If you wish to link to the Site from another website, you must obtain prior permission from EarthRescue. Links should not imply endorsement and must not contain objectionable material. Linking rights may be revoked at any time.

Disclaimer

While EarthRescue aims to provide reliable information and services, your use of the Site and its materials is at your own risk, provided "as is" without warranties. We do not guarantee accuracy or reliability and are not responsible for typographical errors. We disclaim all implied warranties to the fullest extent permitted by law.

Limitation of Liability 

EarthRescue and its affiliates are not liable for any damages of any kind arising from your use of the Site or the Services, including loss of profits or data. Our total liability shall not exceed any monies you have paid to via the Site.

Indemnity

You agree to indemnify and hold EarthRescue and its affiliates harmless from any claims or damages arising from your violation of these Terms or your use of the Site.

Termination

EarthRescue may discontinue the Site or any services at any time without notice. We also reserve the right to modify any services without prior notice.

Governing Law and Jurisdiction

These Terms are governed by the laws of Florida. You agree that any legal action related to these Terms will be filed in Florida’s courts.
